Who we are

theagentadvance.com is operated by Agent Advance, LLC (“The Agent Advance,” “we,” “us” or “our”). We provide commission advances to real estate agents and brokers who have a home under contract.

Information we collect

When you apply for an advance, you give us:

  • Your full name, address, phone number and email address
  • Your company and/or brokerage
  • The address of the home under contract and the advance amount you request
  • The documents you upload: your purchase contract and your compensation agreement

These documents usually include details about the sale, such as the price and the closing date, and information about other people involved, such as the buyers and sellers. We use that information only to review and service your advance.

We also keep what you share with us when you call, text or email us. Calls and texts to our phone number go through our phone service provider, which logs your phone number and details such as the date, time and length of a call. We use this to respond to you and to see how people find us. We do not record calls.

When you visit the site, our website host automatically receives the technical details every browser sends, such as your IP address, browser type, the page requested, and the date and time. This is used to deliver the site and keep it secure.

Cookies and tracking

This website does not use cookies for advertising or analytics, and it does not load tracking tools from other companies. Our explainer video and our fonts are stored on this site, so watching the video does not send your information to a video service.

How we share your information

We do not sell your personal information, and we do not share it with other companies for their own marketing. We share it only as needed to run our business:

  • Service providers. These are companies that host this website, receive and store form submissions, filter spam, deliver email, handle our phone calls and text messages, and provide banking or payment services. They may use your information only to do that work for us.
  • People involved in your sale. This means your brokerage and the closing attorney or title company handling your closing, so we can confirm the transaction and be repaid from your commission at closing.
  • Legal reasons. We share information when the law requires it, such as for a court order or subpoena, or when it is needed to protect our rights, prevent fraud, or keep someone safe.
  • Business changes. If our business is sold, merged or reorganized, your information may transfer as part of that change, and this policy will continue to apply to it.

Text messages

If you give us your mobile number, we may text you about your application or your advance. Message frequency varies, and message and data rates may apply. Reply STOP at any time to stop receiving texts, or HELP for help. We do not sell, rent or share your mobile number or your consent to receive texts with any third party for their marketing.

How we protect your information

Information you send through this site, including uploaded documents, travels over an encrypted (https) connection. Access to applications is limited to the people who need it to review and service advances. No website or storage system is perfectly secure, so we cannot guarantee absolute security.

How long we keep your information

We keep your information for as long as we need it to review your application, provide and collect your advance, and meet our legal, tax and accounting requirements. When we no longer need it, we delete it or remove the details that identify you.

Your choices

  • You can ask to see the personal information we have about you, or ask us to correct or delete it. Some records we are required by law to keep.
  • You can opt out of marketing emails by using the unsubscribe link in the email or by contacting us.
  • You can stop text messages at any time by replying STOP.
